Learn the key aspects of trademark registration with the Mexican Institute of Industrial Property (IMPI)

1. Choose a distinctive and original name

2. Conduct a background search with the IMPI


Before submitting your application, check if a similar trademark already exists. You can perform a free search in the IMPI's Marcanet system. If you want greater security, request a trademark feasibility study with a specialist.



3. Correctly define the goods or services


You must specify which goods or services your trademark will be used for. This is classified according to the Nice system, which groups commercial activities into 45 classes. Choosing the correct class is key to effective protection.



4. Fill out the registration application


You can submit your application online through the IMPI portal or in person. You must provide your information, the trademark information, the chosen class, and attach the logo if you are registering a mixed trademark.



5. Pay the official fee


The cost of the process varies, but on average is around $3,000 MXN per class. Payment can be made online or at a bank teller, and you must attach the receipt to your application.



6. Wait for the IMPI's resolution


Once the application is submitted, the IMPI will review whether your trademark meets the legal requirements. If there are no observations, registration can take between 4 and 6 months. If there are objections, you will have the opportunity to respond.



7. Receive your registration certificate


If all goes well, you will obtain your registered trademark certificate, valid for 10 renewable years. From that moment on, you will be able to legally use the ® symbol and have exclusive rights to your trademark throughout Mexico.
